Overview

Baseline Botanicals ("Baseline", "we", "us", "our") is an online store operated by Dual Dimensional, 24424 Hawthorne Blvd, Ste A, Torrance, CA 90505. We sell mushroom-based edibles — RiZE-X chocolate, RiZE gummies and Dozo Don't Trip gummies — to adults aged 21 and older in the United States, and we publish an independent laboratory certificate for every batch we sell.

These Terms of Service ("Terms"), together with the policies they refer to — our Privacy Policy, Shipping Policy and Refund Policy — govern your use of baselinebotanicals.com and any purchase you make from us (together, the "Services"). By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

Please read Sections 1–4 carefully. They cover who can buy from us, how we verify age, what our products are and are not, and your responsibility for following the law where you live.

1. Who can use our store

  • You must be 21 years of age or older to buy from us or create an account. This applies everywhere we ship, including places where local rules set a lower age or none at all.
  • We sell and ship to street addresses in the United States only — currently 49 states and Washington, D.C. (not Louisiana). We do not ship to PO boxes, APO/FPO/DPO addresses, US territories or freight forwarders. The current list is on our Where We Ship page.
  • You must give us true, current and complete information — including your name, date of birth and shipping address — and keep it up to date.
  • You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or share your account.

2. Age verification

Every order must pass age verification before it ships. We use a third-party service, AgeChecker.Net, which checks the name, address and date of birth you provide against public and commercial records. If your age can't be confirmed that way, you may be asked to upload a photo of a government-issued ID.

  • Orders that fail verification, or where verification isn't completed, are cancelled and refunded in full.
  • An adult signature is required on delivery, and orders cannot be left unattended.
  • You must not buy for, give, resell or otherwise provide our products to anyone under 21, and you must not misrepresent your age or identity. Doing so is a breach of these Terms, and we may cancel any related orders and close any related accounts.

3. Our products

Our products are ingestible, mushroom-based edibles made for adults.

  • No health claims. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease, and nothing on the Services is medical advice.
  • Label figures. Quantities printed on packaging (for example "24,000 mg" or "4,500 mg") are the manufacturer's stated quantity of mushroom extract. They are not a measurement of any active compound, and no potency assay exists for these extracts.
  • Lab certificates. For each batch we sell, we publish the certificate of analysis issued by an independent, ISO/IEC 17025-accredited laboratory, in the laboratory's own format. A certificate reports only the panels and compounds it lists, for that specific batch. "Not detected" means a compound was not found above the laboratory's reporting limit. A certificate does not establish mushroom species, extract quantity, or the absence of anything the laboratory did not test for. Where a panel has not yet been run, we say so on the product page.
  • Use responsibly. Read the full label and warnings before use. Do not use if you are under 21, pregnant or nursing. Do not drive or operate machinery after use. Consult a physician before use if you have a medical condition or take prescription medication. Keep out of reach of children and pets. Check the ingredient list for allergens.
  • Descriptions. We work to describe and photograph products accurately, but colours and packaging may differ slightly from what you see on screen, and manufacturers can change packaging or formulation. We may update descriptions, correct errors, limit quantities or discontinue any product at any time.

4. Following the law where you live

Rules for products like ours vary by state, county and city, and they change. We limit checkout to places we believe we can ship to, but you are responsible for knowing and following the laws that apply to you where you receive and use our products. If a law or regulation affecting your order changes after you order but before we ship, we will cancel the order and refund you in full. We may refuse, limit or cancel any order that we believe would break a law or these Terms.

5. Orders

When you place an order, you are making an offer to buy. We accept your order when we ship it; an order confirmation email is not acceptance. We may decline or cancel any order, in whole or in part, for any lawful reason — including failed age verification, a shipping address we can't serve, suspected fraud or resale to minors, quantity limits, or a pricing or listing error. If we cancel an order after you have paid, we refund you in full to your original payment method. You are never charged for an order we can't ship.

6. Display boxes and wholesale

Our display boxes are packed for retail counters. If you buy display boxes to resell, you confirm that you are a business permitted to sell these products where you operate, and you agree to:

  • sell only to customers aged 21 or older;
  • keep products in their original sealed packaging, with labels, warnings and batch codes intact;
  • make no health or medical claims about them; and
  • follow all laws that apply to your business.

We may ask for business information before accepting a display-box order and may decline wholesale orders at our discretion. For wholesale pricing, contact us. Except as allowed in this section, products are sold for your own personal use.

7. Prices and payment

All prices are in US dollars. Prices, promotions and availability may change without notice; the price you pay is the one shown at checkout when you place your order. Taxes and shipping are calculated at checkout. You agree to give us current, complete and accurate payment information and confirm that you are authorized to use the payment method you provide. If we find a pricing error after you order, we will contact you and let you either continue at the correct price or cancel for a full refund.

8. Shipping and delivery

Orders placed before 12pm PT on a business day (Monday–Friday) ship the same day; other orders ship the next business day. Rates, delivery times and where we ship are set out in our Shipping Policy. Delivery times are estimates, not guarantees, and we are not responsible for carrier delays or events outside our control. Every order ships in a plain box with no branding and no indication of contents on the outside.

9. Returns and refunds

Because our products are ingestible, we cannot accept returns of opened packs. Unopened packs can be returned within 30 days of delivery, and damaged, incorrect or missing items must be reported within 7 days of delivery. Full details are in our Refund Policy.

10. Reviews, comments and feedback

If you submit a product review (we use Loox to collect reviews), a photo, a comment, or other ideas or feedback ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium, including in our marketing. You confirm that your Feedback is honest and reflects your own experience, makes no medical or health claims, and does not infringe anyone's rights. We may, but are not required to, moderate, edit or remove Feedback, and we are not responsible for Feedback posted by you or anyone else.

11. Intellectual property

The Services — including our name, logo, text, graphics, photos, video and the design and arrangement of the site — are owned by Dual Dimensional or its licensors and are protected by US and international intellectual property laws. You may use the Services for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, publicly display or create derivative works from any material on the Services without our prior written consent. Certificates of analysis are issued by the testing laboratory. Product names and brands such as RiZE, RiZE-X and Dozo belong to their respective owners. Shopify's name, logo, and product and service names are trademarks of Shopify.

12. Third-party services and links

We use third-party services to run the store, including Shopify (our e-commerce platform and checkout), AgeChecker.Net (age verification), Loox (reviews), payment processors and shipping carriers. Your use of those services may also be subject to their own terms and privacy policies. The Services may link to third-party websites, including the laboratory that issues our certificates. We do not control and are not responsible for third-party services or websites, and a link is not an endorsement. Any use of optional third-party tools is at your own risk.

13. Relationship with Shopify

Baseline Botanicals is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Baseline Botanicals. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Baseline Botanicals, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Baseline Botanicals.

14. Privacy

How we collect, use and share personal information — including the information used for age verification — is described in our Privacy Policy. Because the Services are hosted by Shopify, Shopify also processes certain information under its Consumer Privacy Policy.

15. Prohibited uses

You may use the Services for lawful purposes only. You may not, directly or indirectly:

  • buy for, or provide our products to, anyone under 21, or misrepresent your age or identity;
  • try to get around our age verification or shipping restrictions — for example by using someone else's details, a freight forwarder, or an address in a place we don't ship to;
  • use the Services for any unlawful purpose or in violation of any federal, state or local law;
  • infringe our intellectual property or anyone else's;
  • harass, abuse, threaten, defame or harm anyone, including our staff;
  • submit false or misleading information, reviews or chargebacks;
  • send spam or unsolicited advertising through the Services;
  • upload viruses or malicious code, or interfere with or bypass the security or operation of the Services;
  • copy, scrape or extract content or data from the Services using robots, spiders, scrapers, AI tools or other automated means, except as permitted in Section 16; or
  • impersonate any person or entity.

We may suspend or end your access, cancel orders and close accounts if we believe you have violated these Terms.

16. Agents

16.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

16.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in Section 16.4 below. In addition, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from accessing, using, or interacting with them.

16.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

16.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services. Agents may never complete age verification on anyone's behalf.

17. Disclaimer of warranties

The information presented on or through the Services, including product descriptions and our summaries of laboratory results, is provided for general information only. The laboratory's certificate is the authoritative record of what was tested and found. Any reliance you place on information on the Services is at your own risk.

EXCEPT AS EXPRESSLY STATED BY BASELINE BOTANICALS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY PRODUCT WILL HAVE ANY PARTICULAR EFFECT. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

18. Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL BASELINE BOTANICALS, DUAL DIMENSIONAL, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. TO THE EXTENT OUR LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.

19. Indemnification

You agree to indemnify, defend and hold harmless Baseline Botanicals, Dual Dimensional, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, including by providing our products to anyone under 21, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

20. Governing law and disputes

These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. You and Dual Dimensional agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, except that either of us may bring an individual claim in small-claims court. Before starting a claim, please email us at support@baselinebotanicals.com so we can try to resolve it informally.

21. Termination

We may end this agreement or your access to the Services (or any part of them) at our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections 3, 10, 11, 13 and 17–23, and any other provisions that by their nature should survive, continue to apply after termination.

22. General

Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, the unenforceable part will be treated as severed, and the rest of these Terms will remain in effect.

Waiver; entire agreement. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and the policies they refer to are the entire agreement between you and us about the Services and replace any earlier versions and any prior agreements, communications and proposals, whether oral or written. Any ambiguity will not be interpreted against the party that drafted it.

Assignment. You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign them without notice to you.

Headings. Headings are for convenience only and do not limit or affect these Terms.

23. Changes to these Terms

You can review the current version of these Terms at any time on this page. We may update, change or replace any part of them by posting the changes here and updating the date at the top. We will notify you of material changes as required by law, and changes take effect on the date stated. Your continued use of the Services after changes are posted means you accept them.
